In 1765 John Vivian was named as a beneficiary in his father's will, to receive his leasehold lands and premises called Devora or Devora Veor in the parish of Philleigh in co. Cornwall when he comes of age.
In 1822 John Vivian of Portland Place was named as a beneficiary in the will of his sister Alice Vivian of Penkalenick, widow.

Gives to his son Quintus Vivian his law books, special pleading precedents, other law manuscripts, and one of his watches.
Gives to his second son George Vivian all his other watches and rings, the books in his libraries at Claverton and Portland Place, the households and furniture, plate, linen, china, brewing vessels and utensils, stock of wines and other liquors, and other goods & chattels at his mansion house in Claverton.
Gives 50 guineas each to John Ennis Vivian of the Inner Temple, esquire, James Edwards of Bristol, esquire, and Thomas Lyddon Edwards late of . . . . . . . in the county of Somerset, esquire, his trustees.
Gives to the said John Ennis Vivian and James Edwards his manors, messuages, farms, lands and other real estates, in trust.
Gives his manor of Wellingborough to the College of Wellingborough in the county of Wellingborough in co. Northampton. All his messuages, farms, lands, tenements and hereditaments at Wellingborough—except one estate which he gives to his fourth son Quintus Vivian—and the rest of his freehold estates in co. Northampton, he gives to the said John Ennis Vivian and James Edwards, in trust, for the benefit of his third son Charles Pasley Vivian, in the form of an annuity of £250. Also gives to his said son the advowson of the church there.
Gives his manor of Claverton with its lands, tenements & hereditaments to the said John Ennis Vivian and James Edwards, in trust, for his son George Vivian.
Names as beneficiaries his four daughters Elizabeth Vivian, Julia Vivian, Emily Vivian and Marianne Vivian.
Appoints his trustees the said John Ennis Vivian and James Edwards, and his son Charles Pasley Vivian, guardians of his son Quintus Vivian and of his daughters Emily and Marianne during their respective minorities.
Appoints his said trustees and his son Charles Pasley Vivian co-executors of his last will and testament.
