Only child, a Barrister-at-Law, Sheriff of Cornwall 1802, Lieut.-Col. Royla Stannary Militia. Entailed his estates on his cousin James Vivian TIPPETT.
John Vivian of Pencalenick, only child, Barrister-at -Law, Sheriff of Cornwall1802 Lieut.Col.Royal Stannary Militia, died 24 May 1817, entailed the estates on his cousin James Vivian Tippet.

James Vivian Tippet Esq. Grandson of Mary Vivian, Eldest sister of the Rev. John Vivian and her husband Mr. James Tippet of Nance, Cornwall.
James V. Tippet assumed upon inheriting " Pencalenick " the surname and arms of Vivian.
Died unmarried on 13 April, 1820 the estates devolved, under the entail, upon his first cousin John Tippet, another grandson of Mary Tippet, eldest sister of the Rev. John Vivian, who assumed the surname and arms of Vivian.

Will of John Vivian....

I John Vivian of Pencalenick do declare this to be a Codicil to my will, I appoint my mother my sole Executrix & Residuary Legatee of all my effects not otherwise given away.
I give to my aunt Richards for her life and afterwards to her children the sum of two thousand pounds reduced annuities. I give to Julia & Elizabeth Reynolds, William Tippet, John Tippet of Crow, Jane Vincent and the wife of the late Stephen Tippet the sum of one thousand pounds reduced annuities each. I give to the aforesaid William Tippet and John Bennett of Redruth & their heirs the sum of two thousand pounds reduced annuities in trust to pay the interest therefrom to Mrs Charles Vivian for life and on her decease to her blind children and on their decease I give the said £2000 stock to be divided amongst the other children. I also give to the aforesaid William Tippet and John Bennett & their heirs the sum of one thousand pounds reduced annuities in trust to pay the interest therefrom for the support of Mary Tippet and on her decease to trasfer the said sum to the children of Johnson Tippet. I also give to the aforesaid William Tippet & John Bennet & their heirs the sum of one thousand pounds reduced annuities in trust to pay the interest therefrom to Mrs Johnson Tippet and on her decease to divide the sum amongst Johnson Tippet
s children. I give to the said John Bennett & his heirs the sum of two thousand pounds reduced annuities in trust to divide the interest there from between his brother Charles, his sister and himself during their lives and on their decease the said sum to go to him and then to his children. I give to James Vivian Tippet of Falmouth Two thousand pounds reduced annuities to make up for the £50 annuity payable out of S & S farms to my aunt Elizabeth Vivian if Captain Andrew Vivian
s joint bond be not paid before my decease I order it be given up to him. I give to the Vicar of St Clements for the time being the sum of two hundred pounds reduced annuities in trust to pay the interest there from for ever to the poor in clothing or fuel on the Sunday next before Christmas day. I give to the rector of Camborne for the time being two hundred pounds reduced annuities in trust to pay the interest therefrom for ever to pay the poor in clothing or fuel on the Sunday next before Christmas day. I give to the trustees of the Cornwall Infirmary at Truro for its use the sum of two hundred pounds reduced annuities. I give to ten pounds to each servant and five pounds to each of the maidservants who may be with me at my decease also I give five pounds to an apprentice I give my cloathes to my own servant. It is my intention that the several legacies of stock above given away be transferred from the three per cent reduced annuities now standing in my name . I order my Executrix to pay the legacy duly for Mary Tippet, Mrs Johnson Tippet for the parish of St Clements & Camborne and the Infirmary. My Executrix to have six moths for the settling the above legacies.
