Marriage Notes:
"EXTREME" DIVORCE CASE.
Judge Decides to Exercise Discretion.
"This is a very unusual case, and one which strains the indulgence of the Court to a very considerable extent," said Mr Justice Langton, in the Divorce Court, on Friday, granting a decree nisi of divorce to Mr Owen Leonard Hanks, of Hampstead, who alleged that his wife, Mrs Ada Louise Hanks, had committed adultery with a man named Black. Mr Hanks asked the Court to exercise discretion in his favour, on account of his adultery with a Mrs Nellie Kiddle Munro.
According to Mr Hank's case, there was a separation in 1913 intended to be temporary, but he failed to persuade his wife to return. In 1914 petitioner met the other woman, then Nellie Hayes, and his adultery with her commenced in the following year. They lived together until July, 1922. Then they quarrelled and parted, and Miss Hayes married about a fortnight later.
DECREE GRANTED.
In the following month she left her husband and returned to petitioner, with whom she had lived since until he filed his petition for divorce. Petitioner was co-respondent in a divorce suit brought by Mr Kiddle Munro, who was granted a decree which was made absolute in July, 1929.
"Mr Hanks appears to have been badly treated by his own wife," said his Lordship. "That, however, hardly justifies Mr Hanks in the steps which he has taken in his own part of the matter. Against that is to be weighed the fact that the lady herself appears not to have suffered in any way. I think the case is an extreme one, but it is one in which in the best interests of everyone I should exercise my discretion in his favour."
Mr Justice Langton granted a decree nisi, with costs against the wife's separate estate.
