"This is the last Will and Testament of me JOHN FLETCHER of George Street Sydney in the County of Cumberland in the Territory of New South Wales, Bootmaker. I appoint Henry Hine Newman, of Redfern Sydney in the Territory aforesaid, Accountant, and EDWARD FLETCHER OF THE SAME PLACE MY SON Executors of this my Will. My family consists of Edward Fletcher, George Fletcher, John Francis Fletcher, Henry Thomas Fletcher, Louisa Fletcher, Susannah Fletcher, Lucretia Fletcher and Mary Anne Fletcher by my wife Mary Ann Fletcher who departed this life on the ------- day of ------- in the year One thousand eight hundred and fifty ------- my real Estate consists of the house now occupied by ------- Porter, Chemist and Druggist situated in George Street Sydney aforesaid opposite Margaret place also the house in which I am now residing situated in Lower George Street in Sydney aforesaid which I wish to be divided among my children hereinbfore named in manner following that is to say when my youngest daughter Mary Ann shall have arrived at the age of Twenty one years I wish the property then to be sold should the majority of my children so desire they are all to have equal shares. I also wish the shares of my daughters to be invested for their whole and sole benefit free from any control whatsoever of their husbands should any of them be married and should any of my daughters die before they arrive at the age of Twenty one years or die without issue such share or shares as they are entitled to shall be equally divided among the remaining portion of my children share and share alike at the time of their decease my life is Insured for one thousand pounds sterling in the Mutual Provident Society that sum also all my personal property and what cash I may be possessed of I wish my Executors to invest in good security and to be equally divided among my children at the time of my youngest child Mary Ann Fletcher arriving at the age of Twenty one years in the manner hereinbefore described. If at any times my sons after they have arrived at the age of Twenty one years are willing or wish to take Five hundred pound sterling for their share and my Executors have sufficient funds in hand and that it will not impair the Estate in that case they are to use their discretion in consenting to pay the amount I have named to any of my sons when they have arrived at the age of Twenty one years and any of my sons who accept of the said sum of Five hundred pounds sterling it is to be distinctly understood they are to have no further claim on my Estate real or personal. My sister Blanch Fletcher is to have the management of my young family as long as she remains single and I wish my Executors to pay her a sufficient amount to bring up my family respectably. I also leave her one pound per week for her own use and benefit as long as she remains single but in the event of her marrying that legacy is to cease. If my property realises a larger amount yearly than is requisite to maintain my family the surplus I wish to be invested in the manner I have before described.* And I declare that if any person herein named or hereafter appointed to be a Trustee of my Will should die or renounce or relinquish or refuse or be incapable to perform the office it shall be lawful for the person so retiring or renouncing (being capable and willing to exercise the power) or if there be no such person for any Executor or administrator of the Trustee who shall then last have died in the Office or if there be no such person for any my administrator to appoint any person to be a Trustee in the room of such first mentioned person or persons In Witness whereof I have hereunto set my hand and seal this third day of July in the year one thousand eight hundred and fifty seven.

* My Household furniture is to be allowed for the use of my family that is those who remain at home with my sister Blanch as long as she remains single in the event of my said sister marrying my Executors are to use their discretion as to who is to have the care of my children until they arrive at a sufficient age to protect themselves — The whole of my stock I possess in carrying on my business to be disposed of and after paying all my just debts the residue to be invested safely as my Executors may deem most fit.

Signed sealed published and declared by the said Testator John Fletcher and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our names as Witnesses thereto — Henry Owen — Thos. McConnell — Michael Connor.

This is a CODICIL to the last Will and Testament of me John Fletcher of Upper Paddington near Sydney Boot Maker, which Will bears date the third day of July One thousand eight hundred and fifty seven. My wife Rebecca Sarah Fletcher and Robert Champley Fletcher and Sarah Blanch Fletcher shall share equally with the Children of my first Wife Mary Ann Fletcher in all and every of my real and personal Estate and my son Francis John Fletcher shall also be Executor and Trustee with the other Executors and Trustees Edward Fletcher my eldest son and Henry Hine Newman appointed by me in my said last Will and Testament and I confirm my said Will in other respects. In the event of my said Wife Rebecca Sarah Fletcher marrying again she shall forthwith be deprived of any further participation and benefit in the household furniture and effects whatsoever left by me for the use of my family. In Witness whereof I have hereto set my hand this Twenty second day of September in the year One thousand eight hundred and seventy three. John Fletcher.
Signed by the said Testator as and for a Codicil to his last Will and Testament in the presence of us present at the same time who at his request in his presence and in the presence of each other have subscribed our names as witnesses:— J. R. Blomfield — Charles Kelsey.
23rd September 1875. This day by Act of Court Probate of the last Will and Testament, with Codicil thereunto annexed, of John Fletcher deceased was granted to John Francis Fletcher one of the Executors in the said Codicil named, leave being reserved to Edward Fletcher and Henry Hine Newman the Executors also named in the said Will to come in and prove. Testator died the 22nd August 1875. Goods sworn at £1000. Probate dated the same day as granted." 9

John married Mary Ann Hely, daughter of John Hely and Lucretia May, on 31 Mar 1834 in St. Philips, Sydney, N.S.W., Australia 1 2. (Mary Ann Hely was born in 1814 in Dublin, Ireland and died on 25 Apr 1852 in Lower George St., Sydney, N.S.W., Australia 10 11 12.)

John also married Rebecca Sarah Rutter on 27 Apr 1858 in Parramatta, Sydney, N.S.W., Australia 3 4. (Rebecca Sarah Rutter was born about 1826, died on 17 May 1897 and was buried in St. John's Cemetery, Parramatta, New South Wales, Australia.)

" On Tuesday, April 27th, at Parramatta, by the Rev. S. Rabone, John Fletcher, Esq., of Lower George-street, Sydney, to Rebecca Sarah, eldest daughter of R. C. Rutter, Esq., surgeon, Parramatta."
