Abstract of the Will of James Vivian of Roswarne in the Parish of Camborne and County of Cornwall, Esq., written 15 Dec 1778, proved 12 Dec 1782. 3
Gives £500 to his mother Julian Vivian, along with an annuity of £50 for the term of her natural life.
Gives £300 to his sister Mary Tippet the wife of Mr. James Tippet of Camborn. Gives to her sons James Tippet and John Tippet £500 each, and to her children Jane, Mary, Stephen, Elizabeth, Edward, Anne, Johnson and William, £100 each, to be paid to each of them with accrued interest when they turn twenty-one.
Gives £300 to his sister Julian wife of Lieutenant William Babb, together with an annuity of £40 for life.
Gives £300 to his sister Anne the wife of Mr. Charles Bennett, and £700 to be shared equally among her surviving children.
Gives £1,000 each to his sisters Jane Vivian and Elizabeth Vivian, spinsters.
Gives £1,000 to Miss Elizabeth Trevenen.
Gives 10 guineas each to his friends John Trevenen of Rosewarne, Esq. and Mr. John Edwards of Hayle Copperhouse.
Gives 5 guineas each to Mr. William Babbs, Mr. James Tippet and Mr. Charles Bennett.
To his servants and apprentice he gives £5 each.
Gives 20 guineas to the poor of the parish of Camborne.
Gives to his brother the Rev. John Vivian, Clerk, and his heirs, his lands, tenements and hereditaments in the counties of Devon and Cornwall, to receive their rents, issues and profits for the term of his natural life, with the remainder to friends the aforesaid John Trevenen and John Edwards.
All the rest of his goods, chattels, rights and credit he gives to his brother, the said John Vivian, whom he appoints residuary legatee and sole executor of his last will and testament.

In a codicil dated 7 Aug 1782 he refers to the bequest he made to his sister Anne Bennett of £700. Directs his executor to ensure she is also paid the interest on said amount at the rate of £4 per Centum per Annum, also giving her an annuity of £10 for life.
Gives to his sister Mary Tippet an annuity of £10 for life.
If his nephew John Tippet outlives his brother the said John Vivian, he gives him his leasehold tenement of Rosewarne.
Gives an additional £100 each to his nephews Stephen Tippet and Edward Tippet.
Gives his servant John Thomas an annuity of £5. To the rest of his servants he gives the an additional £5 each.
