  Research Notes:

John Fox son of Richard Fox the elder was sole executor of the will of his paternal grandfather John Fox of Rayle (1816).

John Fox was co-executor of the Will of his second cousin Richard Proviss Harvey of Church Town Illogan (1831).

John Fox of Illogan was one of the Trustees of the Will of his brother-in-law Arthur Trewartha of Nancekuke (1842).

In 1851 John Fox (61) of Camborne, farmer of 40 acres employing 2 men, and wife Martha (49) of Camborne, were living on Rayle Farm in Illogan. With them were sons (born in Illogan): John (35), farmer of 53 acres employing 2 men, William (33), at home.

In 1861 John Fox (71) of Camborne, farmer, and wife Martha (59) of Camborne, domestic affairs, were living in Rayle Illogan. With them was niece Martha Glasson (14) of Camborne, domestic affairs.

Abstract of the Will of John Fox of the Parish of Illogan in the County of Cornwall, Farmer, written 16 Aug 1861, proved 24 Nov 1862. 5

Gives and bequeaths to his wife Martha the use of all his household furniture, books, pictures, plate, linen, woolen, utensils, and effects, along with a £10 annuity of the rents of his tenement in Illogan Downs currently occupied by Thomas Sleeman and John Knight or their undertenants. He also gives her an annuity of £16 out of the rents of his tenement in Bridge in Illogan, currently occupied by John Tank and others. The said legacies apply for the term of her natural life so long as she remains a widow.

Gives and bequeaths to his son John Fox the above legacies after the passing or remarriage of his said wife Martha.

Gives and bequeaths £10 to his daughter Julia Simmons the wife of William Simmons of Gwennap.

Gives and bequeaths £10 to his grandson William John Fox Simmons.

Gives and bequeaths to his son Arthur Fox the messuage or dwelling house with its shop, store room and adjoining garden which he currently rents from him in Bridge in Illogan, subject to the payment of an annuity of £4 to his son William Fox for the term of his natural life.

Gives and bequeaths to his sons John Fox and Arthur Fox and to his friend William Tank of Bridge, carpenter, his messuage tenement and premises in Nancekuke in Illogan, and also his messuage tenement and premises called Labour in Vain in Illogan, as well as £450, in Trust, that the said John Fox, Arthur Fox and William Tank will shall receive the rents of the said tenements &c. and apply them for the use and benefit of his said son William Fox and his heirs. And if William Fox should die without lawful heirs then he wills that the above go to his son John Fox and his heirs.

All the residue and remainder of his real estate and personal estate he gives and bequeaths to his son John Fox and his heirs, appointing him the executor of his last will and testament.

The Will of John Fox of the Parish of Illogan in the County of Cornwall, farmer, deceased, who died 29 August 1862 at Illogan aforesaid was proved 24 November at Bodmin by the oath of John Fox of Illogan aforesaid, farmer, the son, the sole executor. Effects under £1,500.

John married his second cousin Ann TREWARTHA, daughter of John TREWARTHA of Bridge in Illogan and Rachel MESSER, on 7 Dec 1813 in Illogan, Cornwall. (Ann TREWARTHA was christened on 16 Aug 1795 in Illogan, Cornwall and was buried on 19 Aug 1835 in Illogan, Cornwall.)
