In the Supreme Court of the Colony of Victoria, in the Estate of Josiah Rogers late of 118 Barkly Street Ballarat East, mining investor, I, Jane Rogers of 118 Barkly Street Ballarat East, widow, make oath and say

1. That I am seeking Administration of the Estate of the above-named Josiah Rogers, deceased

2. That Josiah Rogers the above-named deceased departed this life on the twenty seventh day of March one thousand eight hundred and ninety at 118 Barkly Street Ballarat East in the said Colony as I believe Intestate

3. That the said deceased left me this deponent and four children namely Samuel Langdon Rogers, Ellen Rogers, Helena Rogers and Annitha Lavinia Rogers, his only next of kin him surviving and who are as I believe the only persons entitled to a distribution of his estate.

4. That I am the Widow of the said Josiah Rogers deceased and as such claim to be and am as I believe entitled to the administration of the estate of the said Josiah Rogers deceased

5. That I have carefully searched and enquired for a Will of the said Josiah Rogers deceased but have not found or heard of any and I believe he left no will.

6. That the said Josiah Rogers deceased had at the time of his death real property in the Colony of Victoria not exceeding in value the sum of three hundred pounds and personal property in the said Colony not exceeding in the value the sum of fifty pounds

7. That the reason why I did not apply for administration of the estate of Josiah Rogers deceased sooner was that I did not have the means necessary to enable me to do so my late husband's real property being at the time of his death under mortgage for one hundred and fifty pounds and such mortgage still exists

8. That to the best of my knowledge information and belief the said deceased did not within the space of two years proceeding the date of his death convey or otherwise dispose of for other than adequate valuable consideration any real or personal property of which he was seized or possessed....

Sworn at Ballarat in the Colony of Victoria this nineteenth day of May One thousand eight hundred and ninety two.

Gives to her daughter Annetta Lavinia Rogers all her real and personal estate for her own use and benefit.

Appoints Edwin Blomeley of Lydiard Street Ballarat, auctioneer, and James Hambley of Sturt Street, Ballarat, mining investor, executors of her last will.
