Will of Thomas Alfred Cambage late of Milton, Retired Farmer, written 17 Oct 1935, codicil 5 Dec 1935, probate 12 Dec 1940.
THIS IS THE LAST WILL AND TESTAMENT of me THOMAS ALFRED CAMBAGE of Milton in the State of New South Wales, Retired Farmer. 1. I REVOKE all former testamentary instruments made by me. 2. I APPOINT my brother CHARLES CAMBAGE and my nephew ARTHUR MILTON KOYCHEN (hereinafter called "my Trustees") to be the executors and trustees of this my Will AND I DECLARE that all trusts powers authorities and discretions hereinafter vested in my trustees may be exercised by the survivor of them or other the trustees or trustee of this my Will. 3. I DEVISE ALL THAT my farm house and land known as "Applegarth" (in which is included land purchased by me from J. V. Jones) containing a total area of about one hundred and seventy eight acres situated at Milton aforesaid with appurtenances thereof to my nephew WARREN HASTINGS CAMBAGE (son of the said Charles Cambage) in fee simple for his own use and benefit absolutely. 4. I DEVISE ALL THAT my farmhouse and land known as "Tillowrie" containing an area of about one hundred and eight five acres situated near Milton aforesaid and now in the occupation of the said Arthur Milton Koychen with the appurtenances thereof to the said ARTHUR MILTON KOYCHEN in fee simple for his own use and benefit absolutely. 5. I DEVISE AND BEQUEATH all the real and personal property whatsoever and wheresoever of or to which I shall be seised possessed or entitled at my death or over which I shall then have a general power of appointment or disposition by Will except property otherwise disposed of by this my Will or any Codicil hereto UNTO AND TO THE USE of my trustees their heirs executors or administrators respectively UPON THE TRUSTS and with and subject to the powers and provisions hereinafter declared of and concerning the same that is to say: — (a) UPON TRUST that my trustees shall sell call in collect and convert into money the said real and personal property at such time or times and in such manner as they shall think fit (but as to reversionary property not until it falls into possession unless it shall appear to my trustees that an earlier sale would be beneficial) with power to postpone the sale calling in or conversion of the whole or any part or parts of the said property during such period as they shall think proper and to retain any investments existing at my death without being responsible for loss AND I DIRECT that the income of such of the same premises as for the time being shall remain unsold shall from my death be applied as if the same were income arising from investments hereinafter directed to be made of the proceeds of sale thereof and that no reversionary or other property not actually producing income shall be treated as producing income for the purpose of this my Will. (b) MY TRUSTEES shall out of the moneys to arise from the sale calling in and conversion of or forming part of my said real and personal property pay my funeral and testamentary expenses and debts and all Probate Death and Estate Duties whether imposed by the law of the State of New South Wales or of the Commonwealth of Australia. (c) MY Trustees shall invest the residue of the said moneys (which with the investments thereof are hereinafter called "the trust fund") in their names in or upon any investments for the time being authorised by law for the investment of trusts funds. (d) MY TRUSTEES shall stand possessed of the trust fund IN TRUST for all or any my brothers or brother and sisters or sister living at my death of the whole blood and the children or child then living who being male attain the age of twenty one years or being female attain that age or marry of any then deceased brother or sister of mine of the whole blood in equal shares but so that the children of any deceased brother or sister of mine shall take equally between them only the share which their parent would have taken if he or she had survived me. 6. MY TRUSTEES may instead of acting personally employ and pay a solicitor or other agent to transact any business or do any act required to be done in connection with the administration of my estate or the trusts hereby declared including the receipt and payment of money and shall be entitled to be allowed and paid all charges and expenses so incurred and shall not be responsible for the default of any such Solicitor or agent or any loss occasioned by his employment. 7. IT IS MY PARTICULAR WISH AND REQUEST but without imposing upon them or either of them any legal or equitable obligation condition trust or election whatsoever or interfering with their or either of their full and absolute right to the fee simple of the hereditaments hereinbefore devised to them respectively that the said Warren Hastings Cambage and Arthur Milton Koychen shall not sell mortgage charge dispose of or devise the said hereditaments or any part thereof to any other person than a member of the Cambage family and that the said Warren Hastings Cambage shall allow my brother Henry Fisher Cambage and my sister Jane Fisher Koychen to reside in the farmhouse known as "Applegarth" free of charge if they so desire during their respective lives. IN WITNESS WHEREOF I have set my hand to this my Will this seventeenth day of October one thousand nine hundred and thirty five.

I THOMAS ALFRED CAMBAGE hereby declare this to be a CODICIL which I make the fifth day of December one thousand nine hundred and thirty five:— 1. I GIVE AND BEQUEATH to my nephew WARREN HASTINGS CAMBAGE all the furniture pictures linen plate china household effects farming plant carts harness tools and all other personal effects which may be in the farm house or on the farm known as "Applegarth" at the day of my death in addition to the other property devised to him by my said Will. 2. IN ALL OTHER RESPECTS I confirm my said Will. IN WITNESS WHEREOF I have hereunto set my hand the fifth day of December one thousand nine hundred and thirty five. THOMAS A. CAMBAGE.
