Will of Francis Hely, written 22 Aug 1861, probate 19 Jul 1871.
This is the last Will and Testament of me Francis Hely of Sydney in the Colony of New South Wales Shipwright. I appoint my dear wife Ellen Hely and my son Thomas Hely Executrix of this my Will. I give devise and bequeath unto my said son Thomas Hely and his heirs all my right Share and interest at the time of my decease of in and to the building yard and premises in Darling Harbor in the City of Sydney aforesaid adjoining the property of the Gas Company as the same Yard and premises are now enclosed and are now in the occupation of Messieurs Hely and Harper Together with the appurtenances thereunto belonging To hold the same unto and to the use of the said Thomas Hely his heirs and assigns for ever And I give devise and bequeath unto my dear wife Ellen Hely All those two messuages or dwelling houses situate in Jenkins Street Sydney adjoining the said building yard and premises with the land and appurtenances thereto belonging To hold the same unto and to the use of my said wife Ellen Hely during her life without impeachment of waste for her sole and separate use and benefit free from the debts engagements or control of any husband And after her decease I give devise and bequeath the same unto and to the use of my said son Thomas Hely his heirs and assigns for ever And I give and bequeath to my said wife Ellen Hely all the household goods furniture books pictures plate china glass effects and things which shall be in upon at out or belonging to my dwelliing house at the time of my decease for her own sole and separate use and benefit And I give devise and bequeath all the rest residue and remainder of my Estate property and effects real and personal whatsoever and wheresoever and of what nature or kind soever in possession reversion remainder or expectancy of or to which I shall be seized possessed or in any manner entitled or any person in trust for me at the time of my decease unto the said Ellen Hely and Thomas Hely their heirs Executors administrators and assigns according to the nature and quality of the same respectively in equal shares and proportions as tenants in common absolutely (but as regards any estate property or effects which may be then vested in me as Trustee or Mortgage upon and subject to the trusts and Equities affecting the same) the share of the said Ellen Hely to be for her sole and separate use and benefit And in case the said Ellen Hely shall die before me then the whole to go to the said Thomas Hely his heirs Executors administrators and assigns respectively I direct my Executors to pay all my debts out of my personal Estate I revoke all Wills and codicils at any time heretofore made by me and declare this to be my last Will and Testament.
IN WITNESS whereof I the said Francis Hely the Testator have to this my last Will and Testament contained in this and the preceding side of paper set my hand the word "Books" having been first inserted between the twenty third and twenty fourth lines of the first side this twenty second day of August in the year of our Lord one thousand Eight hundred and Sixty one. 19th July 1871. This day upon Petition Probate of the last Will and Testament of Francis Hely deceased was granted to Thomas Hely and Ellen Hely the Executor and Executrix in the said Will. Named Testator died the 21st day of June 1871. Goods sworn at £12,600. Probate dates the same day as granted. 8
