Will of John Richards of Camborne

Written 4 Feb 1816, proved 4 Aug 1824

In the Name of God Amen
I John Richards of the Parish of Camborne in the County of Cornwall Clerk being of sound mind memory and understanding do make this my last Will and Testament in manner following that is to say first I bequeath my Soul into the hands of Almighty God hoping and believing in a Remission of my Sins by the merits and mediation of Jesus Christ and my body I commit to the Earth in a very private manner to be interred And whereas my dear Wife is provided for in Settlement made on her Marriage but in token of the love and affection I have and bear for and towards her I give and bequeath to her for and during the term of her natural life the Furniture in my House at Camborne aforesaid and from and after her decease I bequeath the same in equal shares and proportions to my two Children William and Mary Richards to be divided between them share and share alike save? and except my books which I direct to be divided between my said two Children immediately after my decease And whereas by Indenture feoffment bearing date the Nineteenth day of February one thousand Eight hundred and Sixteen I have given and granted unto my said Son William Richards his Heirs and Assigns all and every my Parts and shares in two Freehold Messuages and Tenements called respectively Trefewha and Trethannas situated in the Parish of Crowan in the said County of Cornwall subject nevertheless to the Payment of such Annuities as I may think Proper to charge thereon And whereas in the event of my Wife's surviving me the greater Part of my Property is secured to her use for her life by her Marriage Settlement and under thus? circumstances it not being probable that there will remain from my in----bered Property sufficient to make my Daughter's income equal to the Rents and Profits to be received by my Son from the Interests I have given him in the said Estates of Trefewha and Trethannas it is my Will therefore that the deficiency to my Daughter Mary shall be supplied by my Son during the life-time of their Mother and that during this period my said Son and Daughter shall Annually make out and state a fair account of their respective Incomes the first statement to be made that day twelve Months next after my decease and if it shall appear that the annual Rents and Profits from the Freehold Property so given to my Son as aforesaid shall be more than equivalent to my Daughter's Income it shall be permitted her to call upon him annually for Payment of such deficiency and in the event of my Son's refusing to give the accounts that may be required or pay the Sums that may be justly demanded it shall and may be lawful for my said Daughter and her Assigns into and upon the aforesaid Messuages and Tenements of Trefewha and Trethannas (if the latter be then in the Possession of my said Son and if not into and upon Trefewha only) to enter and distrain and the distress and distresses there found to take and carry away and to impound or otherwise to sell and dispose of the same until thereby she and they shall be satisfied and Paid such balance as may be justly due & owing from her Brother as aforesaid and further it is my Will that immediately after the death of my Wife my Daughter shall take to herself a portion of my Property (in which I include my Leasehold Dwellinghouse in Camborne Church Town) sufficient when invested in the Public Funds or in the Cornish Copper Company at Hayle (and this to be at her own option) to make her Annual income equal to the Rents which may be received at such time by her Brother from the said Estates of Trefewha and Trethannas but should my Wife die in my life time I direct that this allotment to my Daughter shall be made immediately after my decease and after sufficient Property is secured to her to make her Annual income equal to her Brother's it is my Will that the overplus of my Property (if any) of what nature or sorts soever it be shall be equally --?-- between and amongst my said two dear Children in equal Proportions to be held and enjoyed by them as Tenants in Common and not as joint Tenants and I do hereby Nominate and Appoint my said Son and Daughter Executor and Executrix of this my Will and I do revoke all Wills by me at any time heretofore made and declare this only to be my last Will and Testament In Witness whereof I the said John Richards have to each sheet of this my last Will and Testament contained in three sheets of Paper set my hand and to this the third and last Sheet thereof my Seal this Twenty fourth day of February in the Year of our Lord one thousand Eight hundred and Sixteen John Richards L S Signed Sealed Published and declared by the said Testator as and for his last Will and Testament in the Presence of us who at his request and in his Presence and in Presence of each other have hereunto subscribed our names as Witnesses William Richards - Jenny Hocking - William Holman - Dorothy Jenkin
Whereas I John Richards the Testator named in this Will have republished the same with an intent thereby to make void all and every other Will and Wills at any time heretofore by me made and do confirm and establish this which I have declared to be my last Will and Testament in the Presence of William Richards William Holman and Dorothy Jenkin whom I have desired to subscribe their names as Witnesses hereto and In Witness whereof I the said John Richards have hereunto subscribed my name this fourth day of February in the Year of our Lord one thousand Eight hundred and Nineteen John Richards - Signed by the said John Richards in the Presence of us who at his request and in his Presence have subscribed our names as Witnesses to the above Republication William Richards - William Holman - Dorothy Jenkin

Proved at London the 4th August 1824 before the Judge by the oaths of William Richards the Son and Mary Paull, heretofore Richards Spinster, wife of James Paull, the Daughter the Executors to whom Administration was granted they having been first sworn by Commission duly to Administer. 1
