Will of James Bennett, yeoman of Camborne
written 26 Nov 1803, proved 9 Apr 1804
The last Will and Testament of me, James Bennett of the parish of Camborne in the County of Cornwall Yeoman who being weak in body but of sound Mind Memory and Understanding and first and principally of all I recommend my Soul unto Almighty God and my Body I give to the Earth to be buried after a decent and Christian manner at the discretion of my Executrix hereinafter named and as concerning my worldly Estate and Effects I give bequeath and dispose of the same in the following manner First it is my Will that all the ready Money which I shall die possessed of shall be by my Executrix put to Interest forthwith either in Government stocks or under some other sufficient Security at five pounds P cent P annum and that Jane my Wife shall have the Interest thereof during her life providing she remains a Widow so long but she is not to sell, assign minister? or take the Principal thereof during her life and in case of her second Marriage my Will is that the said Principal is to become the immediate property (together with the future Interest) of my said Wife and of my then surviving Children (in equal portions) and in case of the death of either of my present six Children the Child or Children of such deceased shall jointly receive the respective deceased part thereof Second in case my said Wife remains in Widowhood during her life (my Will is) that at decease the said Principal Money together with what other of my Effects shall then remain in her hands Custody or Possession are to become the joint property of my then surviving Children and of my deceaseds Childs or Childrens Children according to the first Charge herein Third I nevertheless give to my Son Robert and my Son Jonathan (jointly) that House and Gardens in Wheal Kitty Mine in the aforesaid Parish now in the occupation of John Bishop William Thomas and James Rablin for and during the remainder of my present term therein from the end of two years after my said Son Jonathans Apprenticeship Expires Fourth I also nevertheless give to my two Sons James and Matthias that House and Garden in Rosewarne Wartha in the said Parish now in the occupation of Humphry Stodden during the remainder of my term therein also from the end of two years after my said Son Jonathans Apprenticeship Expires but in case my said Wife shall choose to reside in the said House she shall be at full liberty so to do as long as She pleases on paying to my said two Sons James and Matthias the yearly Rent of three Guineas for the same Fifth I also give to my said Son Robert all the Money that is due to me as Purser on Wheal Nelson and Wheal Violet Account Books also I give to my said Son Robert after the end of one year from my decease that Book Case which did belong to his deceased Brother William Sixth I also nevertheless give to my said two Sons James and Matthias the Sum of five Pounds each of lawful British Money to be paid them by my Executrix at the end of twelve Months after my decease and I also give to my said Son Jonathan the Sum of Ten Pounds of like lawful Money to be paid him at the expiration of his apprenticeship auto? be laid out for him at the discretion of my Executrix Seventh I also give to my said Son Jonathan my Wains--t? Burvan? in the Kitchen Chamber and also the Book Case in the Parlour Chamber at the end of one year after his apprenticeship Expires Also I give to my said Son Jonathan his Brother Williams Chest and Tools and one of his other Chests at the discretion of my Executrix Eighth I Give to my Daughter Ann Rules Children two Guineas and to her Son William Bennett Rule my Silver Watch when he attains to fourteen years of age and in case he shall not survive to that age the same shall be given to my Grandson Nicholas Vivian soon as he attains to fourteen years of age and in case he shall not survive to that age it shall be given to my Grandson Joseph Rule when he is fourteen years of age Also I give to my Grandson Nicholas Vivian two Guineas which as also the aforesaid two Guineas are to be paid at the end of twelve Months from my decease Ninth I give to the poor fatherless Children of Camborne the Sum of Five Pounds to purchase them Cloaths (Cloacks?) at the discretion of my Executrix Tenth I give unto Jane my said Wife whom I also appoint the Executrix of this my last Will and Testament after my Debts and Funeral Charges and Legacies aforesaid are paid all and singular the Remainder of my Estate and Effects which shall or may belong or in any wise appertain to me at the time of my decease In Witness whereof I have hereunto put my hand and seal this twenty sixth day of November in the year of our Lord one thousand eight hundred and three - James Bennett (LS) Signed Sealed published and declared by the said James Bennett the testator to be his last Will and Testament in the Presence of Elizabeth Jeffree John Gribbell Codicil Whereas I James Bennett of the Parish of Camborne made my last Will and testament hereunto annexed this twenty sixth day of November one thousand eight hundred and three it is further my Will that my two Sons in Law Captain John Rule and Nicholas Vivian do assist my Executrix in settling of my accounts and to demand and receive any Sum or Sums which shall be due to me at my decease they acting in the same by her order and such Sum or Sums of Money which they or either of them shall receive to be forthwith paid into her hands In Witness whereof I hereunto subscribe my name this twenty sixth day of November one thousand eight hundred and three - James Bennett - Witness hereto - Elizabeth Jeffree - John Gribbell. This Will was proved at London with a Codicil the ninth day of April in the year of our Lord one thousand eight hundred and four before the Right Honorable Sir William Wynne Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of Jane Bennett Widow the Relict of the deceased and the Sole Executrix named in the said Will to whom Administration was granted of all and singular the Goods Chattels and Credits of the said deceased having been first sworn by Commission duly to administer. 1
