EAGLE, EMMA late of Barham in the State of New South Wales — Widow.

THIS IS THE LAST WILL and TESTAMENT of me EMMA EAGLE wife of Chester Aston Eagle of Barham in the State of New South Wales Retired Farmer I APPOINT my said husband CHESTER ASTON EAGLE and my sons EDWARD JOSEPH LEONARD EAGLE and CHESTER ASTON EAGLE JUNIOR as and to be the Executors of this my Will. After payment of all my debts funeral and testamentary expenses I GIVE DEVISE and BEQUEATH all the real and personal property of or to which I may be possessed of or entitled to at the time of my decease to my four sons Edward Joseph Leonard Eagle, Cheston Aston Eagle Junior, Norman Percy Eagle, Stanley Alfred Eagle, and my daughter Olive Victoria Bennett Eagle in equal shares IN the event of either of my said children predeceasing me and leaving issue then the issue of such deceased child shall take per stirpes the share which his her or their deceased parent would have taken under this my Will had he or she survived me. IN WITNESS whereof I have hereunto set my hand at Barham this ninth day of November One thousand nine hundred and twenty-six.

THIS IS A CODICIL to the last will and testament of me EMMA EAGLE therein described as the wife of Chester Aston Eagle of Barham Retired Farmer but now a Widow which said will bears date the ninth day of November One thousand nine hundred and twenty six I Confirm the said will in all respects save that I hereby direct and declare that my son Norman Percy Eagle shall not take any share or interest or part in my said estate and property I declare however that Alice Eagle the wife of the said Norman Percy Eagle shall take the share and the part in the said estate and property that I have under the said will left to my said son Norman Percy Eagle and I Further Declare that the said Alice Eagle shall share equally in my estate with my three other sons Edward Joseph Leonard, Chester Aston and Stanley Alfred and my daughter Olive Victoria Bennett Lilford nee Eagle In Witness whereof the said EMMA EAGLE has hereunto subscribed her name hereto as and for a codicil to her said will on this eighth (8th) day of July 1935.

11th January 1944. On this date Probate of the Will and codicil thereto of the abovenamed deceased was granted to EDWARD JOSEPH LEONARD EAGLE and CHESTER ASTON EAGLE (in the said Will described as Chester Aston Eagle Junior) both of Barham aforesaid, Orchardists, two of the Executors named in the said Will, Chester Aston Eagle, the husband of the said deceased the other Executor named in the said Will having predeceased the Testatrix.
TESTATRIX DIED on the 20th day of October, 1943 (SUBJECT TO THE USUAL ENEMY CONDITIONS)
ESTATE SWORN at the sum of £3912:3:11 nett. ⁶
