WOODS v. WOODS.

Rockhampton. April 4, 1928. Before His Honour Mr. Justice Brennan, in the Supreme Court yesterday, Frederick Miles Woods, tailor, of Rockhampton, petitioned for the dissolution of his marriage with Pearl Mabel Woods on the grounds of desertion. There was so appearance of the defendant, and after the petitioner had given evidence. His Honour granted an order nisi.

The petitioner, who described himself as a tailor, stated he was married to the defendant on February 1st, 1917, at Rockhampton. After the marriage he lived and cohabited with his wife at North Rockhampton, but two years after the marriage she went out to her brother-in-law's station, near Winton. She took the wedding presents away with her. Returning about six months later, she went to reside with her mother, and she was in Rockhampton about a fortnight before he knew she was back. During the time she was away her father used to come in from the bush and stay with witness. Continuing, witness said his wife would not live on the north side, and at her request he took furnished rooms in the city proper. She was still dissatisfied and wanted to go to Sydney, so witness gave up his employment in Rockhampton and accompanied her to Sydney. They were there about six weeks when her mother died and his wife returned to Rockhampton. She went back to Sydney, where witness was working, about six months later. His Hononr found desertion proved and granted an order nisi, returnable in three months.
