"Will of Rose Trenery Prevost, late of Wahroonga, Married Woman.[Abridged]

This is the last Will of me Rose Trenery Prevost the wife of Richard Lewis Prevost of "Kareela" Coonanbarra Road, Wahroonga, Medical Practitioner. I revoke all other Wills and Testamentary dispositions made by me and appoint my said husband and my brother George Trenery Bennett to be the Executors and Trustees of this my Will. I bequeath to my said husband absolutely all the household furniture plate linen china glass books pictures prints musical instruments and other household effects which shall belong to me at the time of my death. I also give and devise to my said husband absolutely my freehold Premises known as "Kareela" aforesaid and in which we now reside free from any mortgage or other Charge which may be thereon at my death. I give all my jewellery and Personal ornaments to any daughter or daughters of mine who shall survive me if more than one in equal shares and in the event of my not leaving any daughter surviving me I give the same to my sister Olivia Trenery Bennett. I bequeath an annuity of one hundred Pounds Clear of all deductions to my cousin and friend Annie Hale during her life and on her death I bequeath such annuity to her daughter Marjorie during her life such annuity to be Paid in equal quarterly Portions the first of Such Payments to be made at the end of three months from my death. And I empower my trustees if they shall think fit to appropriate and invest upon some suitable authorised investment a sum sufficient at the period of appropriation as a fund for answering the said annuity and in the meantime to Pay the annuity out of the moneys to arise from my residuary Personal estate hereinafter devised and bequeathed but the annuity shall after such appropriation as aforesaid be payable out of the appropriated fund exclusively in exoneration of my other estate and effects both real and personal unto my said trustees Upon trust to sell and convert into money such Parts thereof as shall be of a Saleable or Convertible nature and to get in the other parts thereof and I direct my trustees to arise from Such Sale Conversion And getting in And any ready money I may die possessed of Upon trust thereout in the first place to pay the expenses incidental to the execution of the Preceding trust and my debts (including any mortgage or other Charge over my property at Wahroonga) and funeral and testamentary expenses and the whole of the Probate duty and administration expenses in Connection with my estate and in the next place Upon trust if I shall leave a child or children surviving me to pay my husband for his own use during his life an annuity of three hundred Pounds Clear of all deductions and subject thereto as to as well the Capital as the income of my residuary estate and the moneys and investments representing the sam Upon trust for such my children who being sons shall attain the age of twenty one years or being daughters shall attain that age or be married under that age Such Children if more than one to take in equal shares I direct that my trustees shall pay the whole of the income of the expectant share of any Child of mine until it shall become vested to my husband for or towards his or her maintenance and education without being obliged to see to the application thereof. But in the event of me not leaving any Child I direct the trustees of my Will to Pay the whole of the income from my residuary estate and the investments representing the same to my said husband during his life and from and after his death as to as well the Capital as the income of my residuary estate and the moneys and investments representing the same In trust for my brothers George Trenery Bennett and Arthur Trenery Bennett and my sister Olivia Trenery Bennett in equal shares. I declare that if any of my said brothers or sister shall die in my life time leaving issue such issue shall take and if more than one equally between them the share which his or her parent would have taken in my residuary estate if Such Parent had survived me I empower my trustees to postpone for such period as they shall judge expedient the sale conversion or getting in of my real and personal estates or any part thereof respectively....." 6
